DOMESTIC & ORGANISATIONS
“DUTY OF CARE."

Anybody disposing of rubbish has a “Duty Of Care” to check that the company removing their waste is registered as a Waste Carrier - Upper Tier*. This includes waste removed as part of building work, DIY work or any other types of waste.
You should always record the Environment Agency licence and vehicle registration number of any persons or company removing the waste. This means that if it is later found dumped illegally. The perpetrator and not you should face prosecution.
It is a criminal offence to allow rubbish to be fly-tipped, or to fly tip rubbish. There are various levels of penalties for fly-tipping and they all come with a criminal record. The maximum penalty is a fine of £50,000 and along with this could also include 12 months imprisonment.
Serious and organised waste crime is estimated to cost the UK economy at least £600 million a year. ‘MORE HERE’.
*An Environment Agency issued Upper Tier Waste Carriers Licence enables the holder to transport and dispose of non-hazardous waste ethically for anybody. Whereas a Lower Tier waste carriers licence is for the carriage and disposal of waste produced commercially by the carrier only.
